Terms of Use
Version 1 · Effective date: TBD
LEGAL REVIEW REQUIRED. Scaffold text only. Replace with counsel-approved wording before publishing.
These Terms of Use (Terms) govern your access to and use of the Wardobe application (the Service) operated by TBD — sole trader full name (we, us). By creating an account or signing in to the Service you agree to these Terms together with the Privacy Policy and the Cookie Policy.
1. Definitions
- Service — the Wardobe web application that lets you upload full-look photos, automatically detect and crop individual garments, deduplicate them across outfits, and browse the resulting wardrobe and outfit views.
- Outfit — a full-look photo of one occasion uploaded by a User.
- Garment — an individual detected piece extracted from an Outfit by the AI pipeline.
- User Content — any photo, derived crop, embedding or metadata you submit to or generate on the Service.
- Account — your authenticated access to the Service, created via Google OAuth (Section 3).
2. Eligibility
You must be at least 16 years old (the minimum age for consent to information-society services under GDPR Art. 8 as transposed in Poland) and have the legal capacity to enter into these Terms.
3. Account creation
The Service uses Google as its sole authentication provider. By signing in you authorise Google to share your profile name, email address and avatar URL with us solely for the purpose of creating and maintaining your Account. We do not receive or store your Google password.
4. Acceptable use
- You may upload only photos that you have the right to upload. Do not upload photos that depict another identifiable person without that person's consent.
- Do not use the Service to upload illegal content, content infringing intellectual property rights, or content that is abusive, defamatory or otherwise unlawful under Polish or EU law.
- Do not attempt to circumvent rate limits, scrape the Service, or interfere with its security mechanisms.
- Do not attempt to access another User's data.
5. Your content and the licence you grant us
You retain all rights in your User Content. You grant us a non-exclusive, royalty-free, worldwide licence to process your User Content solely as required to operate the Service for you — namely storing the original photo, running it through the AI detection and embedding pipeline, generating cropped derivatives, persisting those derivatives, and displaying them back to you. This licence ends when the content is deleted (Section 9).
We do not obtain rights to display your User Content publicly, distribute it to third parties beyond the sub-processors listed in the Privacy Policy, or use it to train any model.
6. AI processing
The Service uses automated image processing to detect garments, produce visual embeddings, and deduplicate similar garments across Outfits. The processing is assistive: it does not produce decisions that have legal or similarly significant effects on you within the meaning of GDPR Art. 22.
Details of the sub-processors involved and the legal basis for the processing are set out in the Privacy Policy.
7. Availability and disclaimer
We aim for reasonable availability but do not guarantee uninterrupted access. The Service is provided as is, except where Polish consumer law grants you mandatory protections that cannot be excluded.
8. Liability
To the maximum extent permitted by Polish law, our liability is limited to direct, foreseeable damages. Nothing in these Terms limits liability for damage caused intentionally or for matters that, under mandatory Polish law, cannot be limited.
9. Termination and account deletion
You may delete your Account at any time from the Service. Account deletion triggers the cascade described in the Privacy Policy: Outfits, Garments, derived crops and embeddings, scheduled jobs and stored objects are permanently removed within 30 days. Consent records are retained for the limitation period stated in the Privacy Policy for accountability purposes.
We may suspend or terminate an Account if you materially breach these Terms or applicable law. We will, where lawful, give you reasonable notice and the opportunity to cure.
10. Changes to the Terms
We may amend these Terms. Material changes will trigger a re-prompt when you next sign in: you will see the updated text and must accept the new version to continue using the Service.
11. Governing law and disputes
These Terms are governed by Polish law. Disputes are subject to the courts competent for the registered seat of the data controller. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr and contact the relevant Polish consumer-protection bodies.
